In a notable legal development concerning endorsement agreements and contractual disputes, the Madras High Court has delivered its ruling in a case filed by Tamannaah Bhatia against a soap manufacturer, thereby concluding a long-pending matter.
Judgment in Endorsement Dispute
According to a Live Law report, the court dismissed the appeal on April 16 after an actor challenged an earlier order that rejected her compensation application. Tamannaah sought ₹1 crore in compensation, alleging that Power Soaps used her images without permission after the contract period ended.
The division bench, which included Justice P. Velmurugan and Justice K. Govindarajan Thilakavadi, upheld the single judge’s 2017 decision dismissing the case.
Agreement Timeline
As per the case details,
Tamannaah made an agreement with the company on October 7, 2008. This contract allowed the use of her pictures on soap packaging for one year and ended on October 6, 2009. The parties did not renew the agreement.
The actress claimed that despite the termination of the contract, the company continued to display her images on its product packaging without her consent. She argued that this unauthorized use caused harm and requested both monetary compensation and a permanent injunction to prevent further use of her image.
On the other hand, the company claimed that Tamannaah was not entitled to any compensation and argued that she reported alleged damage without evidence.
Court’s Final Ruling
In his earlier decision, the single judge found that the documents the actor submitted did not sufficiently establish that the company was responsible for the continued use or misuse of her images. The court observed that the material presented did not qualify as reliable evidence.
On this basis, the court dismissed the plea and awarded no compensation. The division bench has now reinforced that decision, thereby bringing the matter to a close.
