Trump Warns of Major Economic Setback if Supreme Court Rejects Tariffs
US President Donald Trump says the US economy could suffer greatly if the Supreme Court strikes down his tariff measures.

US President Donald Trump has warned that the country will face severe economic consequences if the Supreme Court overturns his tariff policies. He said this decision could affect America’s chances of regaining economic strength.

Trump stated, “We have a very very big case in the Supreme Court… Our country has a chance to be unbelievably rich again… If we don’t win that case, our country is going to suffer so greatly — but I think we’re gonna have a big victory.”

The president expressed optimism that the court would rule in favor of his administration, calling the case vital for the nation’s future prosperity.

Appeals Court Declares Tariffs Illegal

Last week, the US Court of Appeals for the Federal Circuit in Washington, DC, ruled that most of Trump’s tariffs were illegal. The 7-4 decision questioned the legality of two major tariff actions:

  • “Reciprocal” tariffs introduced in April as part of Trump’s trade war.

  • Additional tariffs announced in February targeting China, Canada, and Mexico to stop fentanyl imports.

Following the ruling, members of Trump’s Cabinet, including Treasury Secretary Scott Bessent, submitted statements warning that overturning these tariffs could harm US foreign policy and weaken the fight against illegal drug trafficking.

Backup Plan Underway

Despite the legal setback, Bessent revealed that the administration is preparing a contingency plan. This plan would come into play if the Supreme Court does not uphold Trump’s use of the International Emergency Economic Powers Act (IEEPA) of 1977, which allows the president to impose broad tariffs during national emergencies.

In an interview with Reuters, Bessent said he was drafting a legal brief for the US solicitor general to highlight the urgent need to fix long-standing trade imbalances and stop the flow of fentanyl into the country.

Bessent expressed confidence in the Supreme Court, saying, “I’m confident the Supreme Court will uphold it — will uphold the president’s authority to use IEEPA. And there are lots of other authorities that can be used — not as efficient, not as powerful.”

The Stakes Ahead

The Supreme Court’s decision will have far-reaching consequences for US trade policy and its relations with key international partners. If the ruling favors Trump, it will solidify his approach to using emergency powers for economic measures. However, if the court strikes it down, it could disrupt trade negotiations and weaken the administration’s efforts to curb illegal fentanyl imports.
